Where do i stand?

Post by Jackrack »

2-3 months ago i was at a casino, playing a bit of roulette on one of the machines before the poker tourney started. Got down to about £7.00 and cashed out cause i was running late.

Any how the machine clogged up when it was printing the reciept - 2 min later manager comes down etc sorts it out and pulls the reciept that came out of the machine totalling to about £340.00 gbp and hand given it me

My heart pounding took it, said thanks and cashed it in, and played poker - nothing said.

3 months down the line i go in the very same casino not been in since, heard nothing, 2 minutes in the manager comes up to me, Mr Collinson can i have a word.

I walk over and he said 3 months ago you took a reciept for 340 quid which you shouldnt have, and you now owe us money, because you knew it wasn't yours.

I told him to send it me in writing as i didnt have the funds to pay on me.

What do you guys think? surely i shouldn't be held responsible for the machine fucking up, and the printing thing, when the manager hand passed it me etc etc.

Cheers :s:

Legally, I think that they might be in the right.

But I'd imagine it would be quite difficult for them to prove and not worthwhile trying to recover the debt.

It's all a question of whether you ever wish to go back to that casino? Just out of interest, where was it?

Gambling debts used to be unenforceable in law for hundreds of years. The law has changed and errors can be recovered. They could write it off under goodwill but if it is a chain they are probably acting under head office instruction.

you need to talk to a solicitor cause this could get messy..

they will have the entire evening on film.. and from a casino contract that i actually read before i signed it a couple of weeks ago, i think they can record video AND SOUND so they will have everything they need to prove you didnt win that money..

time/date stamps on the terminals ingoing cash/outgoing recipts, bet history and win history matched with the security tapesfrom the tables and from the cash desk will prove you took the money knowing full well it wasnt yours..

all of the evidence will go to and stand up in court and you`ll end up oweing them a couple of grand which they will definitely chase you for, go to your local citizens advice as soon as you can (ie tomorrow or monday!) and explain the situation, they might be able to give you advice..

also, if you ignore the letter.. expect a visit from the police.

My brother who works for a law firm in leeds says that they'd win if they took it to court so maybe you might want to work out some sort of compromise to prevent it going to court, and it's not like you have a leg to stand on unless you want to try and pretend that you actually won £340, which i wouldn't start doing.

Or they could think fuck it. leave it for a while, let you think you have got away with it.

They have your address and know what you look like, lets send the chief bouncer and his mates round to cripple you,

Could well be worth paying it bak if you like your legs,

But thats just a thought though !!

yeah, and and i missed out that the casino has a lot of info on you already, name, id, photo, video footage, address, bank details, next of kin, etc etc

you'll be barred from every casino in the country for life... dunno if you're bothered about that, but it closes a few doors in the future

go in, or write to them, send them a few quid a month or something

Maybe you'll be a little bit more honest in future, tut-tut.

By the way, you can buy the film Casino these days for around £3.....there are some nasty people in the casino trade.

If it is 2-3 months after the event when they approached you, there's a good chance they don't have the video any longer.

But don't quote me on that! :D

Who here honestly would refuse a reciept given to you in hand by the manager when you knew it wasn't yours?

Even tho that is besides the point lol!

Anyhow.. just going to wait until the letter comes, and take it from there.

I'll update this thread once i recieve it.

You should have played dumb when he initially gave you the receipt(s) and stated quite loudly "so, is this mine then? and where do I go to cash it in? and they will give me the money back on the ticket(s)?"

As soon as he says yes you are home free.

Hindsight is wonderful. (It takes a sharp mind to think it up on the spot though!)

(Isn't there still a "finders keepers" law within the UK anyway? hence you can "keep" a winning lottery ticket if it is not claimed after 6 mths?)

I would of taken it and not gone back to the mentioned casino, seeing they took two to three months to mention it and even then they waited for you to go in there, suggests they were not going to chase it up, but going back in gave them a much easier way to appoach you.

I would wait until you get it in writing and then make your next move, although be prepared to pay it or some of it later down the line.
